These Terms of Service ("Terms") constitute a legally binding agreement between you and Gomez Media and Music Co., a California S-Corporation ("Company," "we," "us," or "our"), operator of Rehearsal Space and the Dispatch platform. By creating an account or using Dispatch, you agree to be bound by these Terms.
Dispatch is a music-native email marketing platform for independent artists, bands, songwriters, and music professionals. The platform enables subscriber list management, email campaign creation and delivery, campaign analytics, QR code fan acquisition, and music platform integrations.
You must be at least 18 years of age to use Dispatch. By creating an account you represent that you meet this requirement and that all information you provide is accurate and complete.
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at hello@rehearsalspaceapp.com if you suspect unauthorized access.
You agree to use Dispatch only to send communications to subscribers who have explicitly opted in to receive communications from you, promote your own music and creative work, and comply with all applicable laws including CAN-SPAM, GDPR, CASL, and TCPA.
You may NOT use Dispatch to send unsolicited email, use purchased or harvested lists, send on behalf of third parties without authorization, promote illegal activities, send threatening or discriminatory content, or attempt to bypass platform security or sending limits.
Every subscriber on your list must have explicitly opted in to receive communications from you. By adding any contact to your list you represent that valid consent exists and is documented.
Each plan includes monthly sending limits. At 80% usage you receive a warning. At 100% sending pauses until your next billing cycle or upgrade. Hard bounce rates exceeding 5% or spam complaint rates exceeding 0.1% will trigger account review. Rates exceeding 0.5% complaints may result in immediate suspension.
Paid subscriptions are billed automatically through Stripe at the beginning of each billing period. You may cancel at any time — cancellation takes effect at the end of the current period. Subscriptions are generally non-refundable. Refund consideration may be extended for documented technical failures within 14 days of the charge. Annual plans are non-refundable on a prorated basis.
You retain full ownership of all content you create and your subscriber lists. You grant Gomez Media and Music Co. a limited license to process and transmit your content solely to provide the service. Rehearsal Space, Dispatch, and all associated platform elements are the intellectual property of Gomez Media and Music Co.
Your use of Dispatch is governed by our Privacy Policy. As an artist using Dispatch you act as the data controller for your subscriber list. Gomez Media and Music Co. acts as data processor on your behalf.
Dispatch integrates with SendGrid, Stripe, Firebase, and various music platforms. Your use of these integrations is subject to the terms of those third parties. Gomez Media and Music Co. is not responsible for third-party practices.
Dispatch is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service or email deliverability. To the maximum extent permitted by law, our total liability for any claim shall not exceed the amount you paid us in the three months preceding the claim.
You agree to indemnify and hold harmless Gomez Media and Music Co. from any claims arising from your use of Dispatch, violation of these Terms, violation of third-party rights, or violation of applicable law.
You may terminate your account at any time by contacting hello@rehearsalspaceapp.com. We reserve the right to suspend or terminate accounts that violate these Terms. Termination for cause does not entitle you to a refund.
These Terms are governed by the laws of the State of California. Disputes shall be resolved in courts located in Los Angeles County, California. You agree to attempt informal resolution for 30 days before initiating legal action.
We may modify these Terms at any time with notice by email. Continued use after the effective date constitutes acceptance.
